An employment contract is a legal agreement defining the terms and conditions of a legal employment relationship, addressing the rights, expectations, and obligations of both the employer and the employee.

Chinese law requires a written employment contract with specific and mandatory clauses to be held by both the employer and the employee.

What types of employment contracts can I sign in China?

There are three main types: fixed-term employment contracts, open-ended employment contracts, and contracts terminated upon the conclusion of a specific task.

Can I set a probationary period for my employee?

It is not mandatory under Chinese laws, but a probationary period may be set upon mutual agreement. The specific period may vary according to the type and length of your contract.

Do I need a probationary review to guarantee that my employee is competent?

We advise having the review before the expiration of the probationary period to avoid disputes.

How much should I pay my employee during the probationary period?

Chinese law states that the salary paid for employees during this period should not be lower than the minimum salary level for the same position, or less than 80% of the agreed figure on the contract. It should also not be less than the local minimum salary standard.

May I establish disciplinary rules in the contract?

Yes. However, since this relates to internal management, we suggest using the Employee Handbook for that.

Can we implement flexible working hours?

In China, a standard working hour system usually applies. However, flexible working hours may be approved by local authorities according to the nature of the business.

What can I negotiate in an employment contract?

Specific clauses that are not limited by laws and regulations: for example, remuneration, conditions for job transference, appraisal of performance, etc.

What other documents do I need for a formal employment contract?

It varies from case to case. Two typical annexes to employment contracts are the Job Description and the Employee Handbook.

How long does it take for the contract to become effective?

Domestic employees can begin working on the execution date without any other special statutory procedures. Foreign employees, however, need a Chinese work permit. Application times to process the work permit vary from location to location.
